Please take the time to read the following terms and conditions carefully. This Agreement is a legal document, which sets out your rights and obligations, and those of Go With Your Gut Clinic. You must read carefully and agree to the information set out in this agreement carefully before starting a Go With Your Gut Service. ACKNOWLEDGEMENT AND RELEASE OF LIABILITY
Fiona Murphy is a health coach who trades under the
company “Polished Health & Beauty for the Go With
Your Gut Health service. Fiona is a scientist, who has
20 years of experience investigating and researching health because of her own
functional bowel, mental health, digestive, hormonal and gut health struggles.
She has worked in the field of microbiology and in medical sales and marketing
of drugs and skin products for a decade. Fiona is not a doctor, a nurse or a registered
dietician, or nutritionist. Fiona is not a medically qualified professional and
does not medically diagnose any condition or symptom. This coaching is not
intended as a diagnosis, prescription, treatment or cure for any disease or as
a substitute for regular medical care for any physical or mental ailment. The
information provided in services listed should not be taken to be, and is not a
substitute for personal medical advice and instruction. Before engaging in any
activity, behavioural change, supplement program or lifestyle change, you
should seek medical advice from a registered medical professional. Exercise and
lifestyle change carry with it an inherent risk that for which Go With Your Gut
or Fiona Murphy is not liable. The client has the right to ask the rationale
behind a requested activity, behavioural change or lifestyle change as well as
the right to refuse the execution of said activity, behavioural change or
lifestyle change. You are given the information but you are responsible for
carrying out any actions at your own risk. Fiona guides people to reach their
health goals and is not acting in the capacity of a doctor, licenced dietician-
nutritionist, psychologist or other licenced or registered professional. None
of the advice you are given constitutes medical or therapeutic advice of any
kind. It is simply educating you on your options to navigate your
digestive/hormonal/skin health issues, educating you on how the body functions
and what the body may require to heal itself.
DECLARATION:
I realise that Go With Your Gut Clinic may
recommend the use of allied health care providers to coincide with this
program. I am aware that what I am embarking upon is not a quick fix in any
way, shape or form but will require effort on my part to achieve my health
goals. I accept that my involvement is a long-term commitment and I understand
that failing to implement any part of my program will reduce my chances of
success. I acknowledge and I understand Go With Your Gut Clinic is not a health
consultant/ practitioner and not a physician, and that I should see a doctor if
I think I have a medical condition. I cannot Go With Your Gut Clinic
responsible for failure to diagnose or treat an illness, nor will Go With Your
Gut Clinic be liable for failure to prevent future illness. Go With Your Gut Clinic
has informed me that I should contact my doctor when adopting any new health
regime.
By signing the form below and clicking the
appropriate boxes you (the client) declares, “I Accept”: (i) I acknowledge that
my participation in Holistic Health Coaching is expressly conditioned on my
agreement to each of the terms of this electronic document. I acknowledge and
agree as follows:
1) Physical exercise, sport, recreational
activities, behavioural changes and lifestyle changes may cause injury. I understand
that there is an inherent risk of injury when choosing to participate in any
physical exercise, sport, stretching, wellness, lifestyle changes and/or
recreational activities. My participation is a voluntary activity in all
respects and I assume all risks of injury and illness that may result from such
participation in any individual activities and changes in behaviour and
lifestyle.
2) As the participant, I recognize and acknowledge
that there are risks of physical injury and I agree to assume the full risk of
any injuries (including death), deteriorations in health, damages, or loss
which I may sustain as a result of participating in any and all activities
arising out of, connected with, or in any way associated with any of the
services listed in (i). I acknowledge that participation in these activities
and lifestyle changes are voluntary and I will speak with a licensed medical
professional prior to engaging in any recommendations in behavioural changes or
lifestyle changes from Go With Your Gut Clinic for any of the services listed
in (i).
3) I, on behalf of myself , do hereby fully release
and discharge Go With Your Gut Clinic and their agents and employees from any
and all liability, claims, and causes of action from injuries or illness (including
death), deteriorations in health, damages or loss which I may have or which may
accrue to me on account of participation in suggested services in (i). This is
a complete and irrevocable release and waiver of liability. Specifically, and
without limitation, I (the client), on behalf of myself, hereby release Fiona
Murphy/ Go With Your Gut Clinic from any liability, claim, or cause of action
arising out of Go With Your Gut Clinic negligence. I , on behalf of myself,
covenant not to sue Go With Your Gut Clinic for any alleged liabilities,
claims, or causes of action released hereunder.
4) I further agree to indemnify and hold harmless
and defend Go With Your Gut Clinic from any and all claims resulting from
injuries or illness (including death), deteriorations in health, damages, or
loss, including, but not limited to attorneys’ fees, sustained by me arising
out of, connected with, or in any way associated with my participation in
services listed in (i).
5) In the event of any emergency, I authorize Go
With Your Gut Clinic to secure from any licensed hospital, physician and/or
medical personnel any treatment deemed necessary for my immediate care and
agree that I will be responsible for payment of any and all medical services
rendered.
5) Go With Your Gut Clinic may obtain, on your
request, a set of laboratory test results (for an additional fee unless
advertised otherwise) from one or more Certified Laboratories in the United
States, UK or European Union and provide you with a nutritional interpretation
of those test results that you can use exclusively as an educational tool for
personal health purposes. Your doctor may use the same test results to diagnose
and treat disease, but Go With Your Gut Clinic does not diagnose or treat any
disease. The information we provide is not intended to, cannot, and should not
be expected to be a substitute for a personal consultation with your own
qualified doctor. We do not accept any liability for any failure to identify
any medical condition or disease; this is not the purpose of the services
listed in (i).
6) I have been advised by Go With Your Gut Clinic to
consult with a licenced medical physician before I undertake any service
program listed in (i). I certify that I am in good health and sufficient
physical condition to properly participate in these services; that I am
knowledgeable about the proper use of any and the rules of any activities that
I will participate in; and that I will carefully read the operating
instructions for any fitness equipment prior to use and will operate such
equipment in strict accordance with instructions. I will not take any action
based solely on the advice received. I will consult my doctor:
a) For any medical interpretation of my test results;
b) Before taking any nutritional, herbal,
homeopathic or hormonal supplementation;
c) If you rely on, buy or use a product or therapy,
you do so at your own risk. Each person is different, and the way someone
reacts to a product or therapy may be significantly different from another. Go
With Your Gut Clinic cannot predict how you may react to any particular product
or therapy.
7) Go With Your Gut Clinic may provide you with
information relating to products that we believe might benefit you, but such
information is not to be taken as an endorsement or recommendation. Some such
products may not be available without a prescription, but we do not dispense or
prescribe any prescription products. The information provided is intended for
educational purposes only and should not be taken as professional medical
advice or used as a substitute for medical care. We are not responsible for any
adverse affects or consequences that may result, either directly or indirectly,
from that information.
8) I understand that I am receiving health coaching
to improve my health. I agree that what I am receiving are suggestions to
improve my health and I have not received any guarantees regarding these
suggestions.
9) I agree to the release of any written or video
testimonials upon initial program completion.I, the client, have read and fully
understand this Acknowledgement and Release of Liability set forth above,
including the permission to secure medical treatment and the release of all
claims, including claims for the negligence of Go With Your Gut Clinic.I am 18
years old or older or I am the parent of guardian of a child attending Go With
Your Gut I understand that my signed waiver will be retained in my clients/my
childs personnel file. This document is binding upon me and my heirs, children,
wards, personal representatives and anyone else entitled to act on my behalf. Please

COPYRIGHT:
All material, written or otherwise, is protected by
copyright and should not be shared or reproduced without permission. Any
pictures or videos that are taken during 1-1 sessions may be used for social
media and marketing purposes. The client will be notified for any photographs
and videos that are being taken and also has the right to decline the coach to
film or photograph them if they feel it may make them uncomfortable. Please
tick the box below to accept these copyright conditions.
CANCELLATION POLICY:
Any session cancelled or postponed by you within 24
hours of the start time of the scheduled session, or any non-attendance by you
at a session, without explanation will incur €75 deposit cancellation. Any late
cancellation will result in the session being deemed as used, and you will not
be entitled to a refund or replacement for such session. If there is reasonable
reason for cancelling or rescheduling the deposit can be used for this.
EMAIL SUPPORT: 2 short
telephone calls or couple of emails is covered under your initial fee and is permitted
by both of us to ensure you get the support you need on your health journey. A
response to your email is guaranteed within 48 hours Monday – Friday. If
ongoing emails or calls are made to Go With Your Gut Clinic looking for further health support a €100
consultation charge will be applied.
PRIVACY POLICY: I have read
and accept the privacy policy for Go With Your Gut Clinic which is stated at
the following web address:
REFERRAL PROGRAM: If you refer
a friend or family member for Holistic Lifestyle Coaching, you will receive 10%
of the coaching fee they pay. This payment will be transferred to the bank
account from which you purchased the services listed in i). You must make
contact with Go With Your Gut Clinic prior to the referral purchase.
REFUND POLICY: As this is an educational service, no refund may be given under
any circumstances.

We are the owners of the
information collected on this site and via email correspondence during coaching
packages. We only have access to/collect information that you voluntarily give
us via email or other direct contact from you. We will not sell or rent this
information to anyone. We will use your information to respond to you,
regarding the reason you contacted us. With exception to below in (i), we will
not share your information with any third party outside of our organization,
other than as necessary to fulfill your request, e.g. to ship an order.
i) We only share and disclose
your information in the following situations:

with Laws: We may disclose your information where we are legally required to do
so in order to comply with applicable law, governmental requests, a judicial
proceeding, court order, or legal process, such as in response to a court order
or a subpoena (including in response to public authorities to meet national

Medical Information: In order
to provide you with an optimal coaching service and an understanding of your
current state health status, you may be asked to disclose your medical history.
Again, the storing of this information abides by GDRP regulations. This means
any physical copies are kept under lock and key and any digital copies are kept
on encrypted devices.
b) Payment Data
We collect data necessary to
process your payment if you make purchases, such as your payment instrument
number (such as a credit card number), and the security code associated with
your payment instrument. All payment data is stored by our payment processor
and you should review its privacy policies and contact the payment processor
directly to respond to your questions.
c) Information automatically collected
We automatically collect
certain information when you visit, use, or navigate the Site. This information
does not reveal your specific identity (like your name or contact information)
but may include device and usage information, such as your IP address, browser
and device characteristics, operating system, language preferences, referring
URLs, device name, country, location, information about how and when you use
our Site and other technical information. If you access our site with
